Terms of Service

The short version. Night Shift is a tool for tracking your own work and money. You own your data; we don't. The income certificates we generate reflect what you typed in — we don't audit them, and they're not financial, tax, or legal advice. Subscriptions auto-renew through Stripe until you cancel. We can change or end the service. Don't use it for anything illegal. Thanks for being here.

1. Acceptance

By using Night Shift — the website at nightshift.cash, the Progressive Web App, the API at api.nightshift.cash, and any related services (collectively, the "Service") — you agree to these Terms. If you don't agree, please don't use the Service.

2. What Night Shift is

Night Shift is an offline-first money and shift tracker for service-industry workers. It runs primarily in your browser and stores your data on your device. It is not a bank, broker, lender, financial advisor, tax preparer, accountant, lawyer, or licensed professional of any kind. Nothing in the app or on the website is financial, tax, legal, or investment advice.

3. Your account (or lack of one)

Night Shift does not require an account to use the core app. If you start a paid subscription, your "account" is your Stripe customer record — identified by your email and managed via the Stripe billing portal. You're responsible for keeping that email address and any device PIN secure.

4. Subscriptions, trials, and billing

Stripe processes all payments. By starting a subscription, you also agree to Stripe's terms of service.

5. Income verification certificates

Important. Income certificates generated by Night Shift summarize self-reported data that you have entered into the app. We do not audit, verify, or validate the accuracy of the underlying figures. A certificate confirms that, on a specific date, the totals shown were what your Night Shift app reported — nothing more.

Certificates are intended as informal proof-of-income for landlords, lenders, and similar parties willing to accept self-reported records. They are not tax returns, audited financial statements, IRS forms, or employment verification. Do not use them for any purpose where audited or third-party-verified income documentation is required.

You are solely responsible for the accuracy of the data you enter and for any use you make of a certificate. Submitting a knowingly false certificate to a third party may carry legal consequences for you. Don't do that.

You own the data you enter into Night Shift. We do not claim ownership of your shifts, jars, expenses, goals, or anything else you log. Because the app is offline-first, most of your data never reaches us — it lives on your device. See the Privacy Policy for the specifics.

You grant us a limited license to process the small amount of data we do receive (waitlist email, subscription record, certificate inputs, contest opt-in) solely to provide the Service.

8. Our content

The Night Shift name, logo, marketing copy, app interface, and underlying code are owned by us or our licensors and are protected by copyright, trademark, and other laws. We grant you a personal, non-transferable, revocable license to use the Service for its intended purpose. We don't grant any other rights.

9. Service availability and changes

We will try to keep the Service running, but we don't promise uptime, performance, or that any specific feature will remain available. We may add, change, suspend, or remove features at any time. If we make a material adverse change while you have an active paid subscription, we'll do our best to give you reasonable notice.

10. Termination

You can stop using the Service at any time — close the app, cancel your subscription, clear your local data, or email us to delete what we hold.

We may suspend or terminate your access if you breach these Terms, abuse the Service, or use it in a way that creates legal or operational risk for us or other users. We'll generally try to warn you first unless the breach makes that impractical.

11. Disclaimers

The Service is provided "as is" and "as available," without warranty of any kind, express or implied, including without limitation the implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that your data will not be lost. You use the Service at your own risk.

12. Limitation of liability

To the fullest extent permitted by law, Night Shift, TresPies LLC, and our service providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid us in the 12 months before the claim, or (b) twenty US dollars ($20). Some jurisdictions don't allow these limits — in those, our liability is limited to the maximum extent permitted by law.

13. Indemnification

You agree to defend and indemnify us against claims, losses, and costs (including reasonable attorneys' fees) arising from your misuse of the Service, your violation of these Terms, or your violation of someone else's rights — including any third party who relies on a certificate you submitted with inaccurate data.

14. Governing law and disputes

These Terms are governed by the laws of the State of Wisconsin, USA, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in Wisconsin, and you consent to that jurisdiction. Nothing in this section limits any rights you have under mandatory consumer-protection laws in your home jurisdiction.

15. Changes to these Terms

If we make a material change, we'll update the date at the top of this page and, where appropriate, notify active subscribers by email. Continuing to use Night Shift after a change means you accept the updated Terms. If you don't accept them, please stop using the Service and email us to close out.
